1. Introduction
1.1 - This is the online store for Sefam Medical Ltd, intended for use by private patients who hold a OSA Prescription by a qualified physician, for the UK (United Kingdom) only. We cannot accept any orders for anywhere outside of the UK.
1.2 - If you wish to contact Sefam Medical Ltd, our address is displayed above, along with a contact email address and phone number of our UK Customer Service team.
2. Ordering From Us
2.1 - You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the Products you have ordered. Please note orders cannot be expedited after placed online.
2.2 - All orders must have a VAT Relief Self-declaration in order to check out, if you are unable to make the self-declaration then you are unable to make an order.
2.3 - Acceptance of orders by ourselves happens upon despatch of your order, you will receive an email from our Customer Service team when your order has been despatched. See Delivery Policy for information on despatch and delivery
2.4 - We have the right to refuse an order at our own discretion. Reasons for possible order cancellations include, but are not limited to, the following:
- Stock Error – Item was showing in stock but not physically stocked in warehouse.
- Payment Error – Payment was not authorised or was marked as suspicious.
- Pricing Error – Item was sold at a price not deemed to be correct by ourselves.
- Self-Declaration Error – You were deemed to not meet eligibility for VAT relief.
Any order cancellations will receive an order cancellation acknowledgement by email, if payment for your order had been taken then this will be refunded at the time of that email being sent. Monies returned may take up to seven working days to arrive into your original payment method, dependant on provider.

2.5 - VAT Relief Elibigility
Items sold on the Sefam UK (sefam.co.uk) website are for private patients that hold a sleep apnoea prescription only. You must agree you hold a prescription, are over 18 and that the goods are for your own personal use before you are able to check out, this is self-declare eligibility for VAT relief on your purchase. We require no other evidence, other than your self-declaration. If you do not tick the box, or agree to the terms, you will be unable to checkout. If you are in doubt whether you are applicable for VAT relief, or if you are a business customer, please contact customerserviceuk@sefam-medical.com

The below “Declaration of VAT Relief Eligibility” applies to all customers who place an order on the Sefam Medical Ltd website. By placing an order, you agree to the below declaration.
DECLARATION OF VAT RELIEF ELIGIBILITY
Patient
I, the patient (the name and billing address associated with my purchase), are over 18 and I declare that I am the recipient of the goods purchased and the goods will be used for my own use. I hold a prescription for Obstructive Sleep Apnoea from a qualified physician. I understand that special instructions may apply for my device and I will consult a qualified physician if in any doubt. I have read HMRC Notice 701/7 and agree that I qualify for VAT exemption.
Supplier
Sefam Medical Ltd, Company Number 13500192, are supplying the customer with the medical equipment with VAT relief as the patient has read and agreed to the terms of sale above. The patient has self-declared that they are over 18 and hold a prescription for Obstructive Sleep Apnoea by a qualified physician.
3. Pricing
3.1 - All prices and charges on the Website are in the currency indicated on the Website.
3.2 - Where we charge separately for packing, carriage and other relevant charges, the appropriate carriage charges are clearly displayed at checkout.
3.3 - All prices on our website may change at any point without prior notice. Orders may be cancelled if the pricing on any items were deemed to be incorrect, see 2.4.
3.4 - We accept payment by credit or debit card or such other means as may be specified on the Website. If you pay by credit or with debit card, payment is authorised and deducted upon acceptance of your order. If you use another method of payment as offered on the Website, the time of payment may differ.
3.5 - Our site contains a large number of Products. It is always possible that, despite our reasonable efforts, some of the Products on our site may be incorrectly priced. If we discover an error in the price of the Products you have ordered we will contact you to inform you of this error and we will give you the option of continuing to purchase the Product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing. Please note that if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the Products to you at the incorrect (lower) price.
4. Delivery
4.1 - Delivery will be to the address specified on your order, which must be within the United Kingdom. We are unable to deliver to PO boxes or BFPO addresses.
4.2 - We do everything we can to deliver goods as soon as possible. However, occasionally delivery dates and times may be affected by factors beyond our control and therefore they cannot be guaranteed. Estimated delivery dates and/or times are an aim and not a guarantee.
5. Cancellation And Returns Policy
5.1 - You have the legal right to cancel your order with us, from time of order until 30 days after receipt of the order. For the right to receive a full refund, the item must be in the same condition as when you received it (Brand New in Box). If your item is faulty, please see 5.3.
5.2 - If you wish to cancel or return your order, please contact customerserviceuk@sefam-medical.com. If you contact us before you receive your despatch confirmation, it may still not be possible for the order to be cancelled in time. Receipt of your email is not a guarantee the order will be cancelled before despatch.
5.3 - Faults – In the unlikely case the product you receive is faulty, you are eligible for a refund, providing you are within the warranty timeframe. Warranty for all products sold on the sefam.co.uk website is 30 days the day you receive the product(s) unless otherwise stated on the individual products. Products sold by ourselves that have a warranty beyond the default 30 day period are “S.Box” which is 2 years (This is for the BOX only, all consumables are 30 days unless otherwise stated). If you return any product to us due to a fault (Unless they are faulty due to your own neglect), then you will be refunded in full, inclusive of the delivery charge applied to your order.
5.4 - We are permitted by law to reduce the amount you will be refunded in reflection of any reduction in value to the products that you have been caused. Items used will also have a reduced refund value, unless faulty, as these products are deemed diminished upon use.
6. Manufacturer Guarantees
6.1 - All guarantees and/or warranty are 30 days for all products we supply unless otherwise stated. The “S.Box” comes with a 2 year guarantee/warranty. If you encounter any issues with any product purchased from sefam.co.uk, please contact our Customer Service team who will be able to assist.
7. Liability
7.1 - We only supply the Products for domestic and private use. You agree not to use the Products for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
7.2 - If, for any reason, we are liable for any damages, other than those for death or personal injury caused by our negligence (or any other matter for which we are not able to limit or exclude our liability due to applicable law), our total liability shall be limited to the amount of the Product purchased.
7.3 - By purchasing a Product, you agree that in no circumstance shall we be liable for any indirect, incidental, special or consequential damages, including, but not limited to:
(a) loss of income or revenue
(b) loss of business
(c) loss of profits or contracts
(d) loss of anticipated savings
(e) loss of data
(f) waste of management or office time however arising and whether caused by tort (including negligence), breach of contract or otherwise , even if foreseeable, arising out of or in any way connected with the use of a Product, under any law or on any basis whatsoever whether contractual or otherwise, except in relation to death or personal injury caused by our negligence (or any other matter for which we are not able to limit or exclude our liability due to applicable law).
8. Events Outside Our Control
8.1 - We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below in Clause 8.2.
8.2 - An “Event Outside Our Control” means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
8.3 - If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract:
- we will contact you as soon as reasonably possible to notify you; and
- Our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.
- Where the Event Outside Our Control affects our delivery of Products to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.
- You may cancel a Contract affected by an Event Outside Our Control which has continued for more than 30 days. To cancel, please contact us. If you opt to cancel, you will have to return (at our cost) any relevant Products you have already received and we will refund the price you have paid, including any delivery charges.
9. Governing Law and Jurisdiction
9.1 - The Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
10. Disclaimer
10.1 - No claim is made by Sefam Medical Ltd. nor any claim in relation to any of the products available for purchase via its websites to diagnose, cure or prevent any specific disease or condition. It is the responsibility of the purchaser to decide if the product would be of benefit to them or not. If in doubt, please consult your doctor or other health adviser.
11. SEVERABILITY
11.1 All terms and conditions are distinct and severable from one another. If at any time one or more of these Conditions become invalid, not applicable or unenforceable for any reason, all other provisions remain shall in place and fully enforceable.
12. Other Important Terms
12.1 - You may not assign, sub-license or otherwise transfer any of your rights under these Terms.
12.2 - If any provision of these Terms is found by any court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force and effect.
